Derbyshire Terms & Conditions
VERY IMPORTANT: By booking a Speed Awareness Course, you agree to be bound by these terms and conditions.
Definitions:
- "Scheme" - an educational driver training programme offered as an alternative offer to prosecution.
- "Course" - the Course or forum where the Scheme is given to you.
- "Booking Period" - 14 days from the date of the offer letter from Driving Services.
- "Completion Period" - 140 days from the date of your alleged offence.
- “Driving Services” – a trading division within DriveTech (UK) plc
a) Booking:
You must book and pay for your Course within the Booking Period by either booking online or telephoning Driving Services' Police Customer Care team. Booking online is a secure and quick method and is as safe as booking over the phone. When booking online, you can select your preferred date and time. When booking by telephone, you will be offered a limited selection of dates and times and you will be expected to select one.
b) Failure to book:
Failure to book and secure your place within the Booking Period will result in your file being returned to the police and the offer of the Scheme will be withdrawn.
c) Payment:
Payment can be made by most credit and debit cards, by cheque or by postal order. Payment by instalments is not possible. We are also unable to accept post-dated cheques or cash. Cheque or postal order payments for a Course must bemade payable to Driving Servicesand received by Driving Services within 7 days of the date of booking to secure your place.Once you have booked your Course, it is non-transferable and non-refundable.
d) Cheques:
Any cheque returned to Driving Services without sufficient funds in your account will result in an administration charge of £8.00. In this event, we may cancel your booking, but you may be able to reschedule your Course(also see Clause i). Any subsequent payments must be made by credit/debit card. If you are unable to satisfy this requirement, your file will be returned to the police and the offer of the Scheme withdrawn.
e) Completion date:
Your Course must be completed within the Completion Period. If you are unable to complete within this time, your file will be returned to the police and the offer of the Scheme will be withdrawn.
f) Course completion:
You must satisfactorily complete the Course by attending in person, arriving on time, be present for the entire duration and participating fully (which shall be determined at the sole discretion of the trainer).Mobile phones and/or pagers must be switched off during the Course.
g) Non-attendance:
If you are unable to attend your Course:
- Due to exceptional circumstances: i.e. bereavement, medical grounds or you are a parent or carer and your dependant is taken ill, you will be able to reschedule your Course, subject to availability and payment of a rescheduling fee of £30 (also see Clause i). Documentary evidence justifying your non-attendance will be required.
- For any other reason: you will be able to book another Course, subject to availability and payment of the full Course fee again which can only be made by credit or debit card.
h) Non-completion:
If you are unable to complete your Course:
- Because you arrive late: you will be refused entry, your file will be returned to the police and the offer of the Scheme will be withdrawn, unless you reschedule your Course. If you reschedule your Course, you will incur rescheduling fees (also see Clause i) unless the delay has been caused through major disruption to the local public transport of road network, e.g. a major incident resulting in tube/train or road closures. You will be expected to leave sufficient time for your journey allowing for general delays.
- Because you fail to establish your identity satisfactorily (also see Clause j): you will be refused entry, your file will be returned to the police and the offer of the Scheme will be withdrawn, unless you reschedule your Course. If you reschedule your Course, you will incur rescheduling fees (also see Clause i). No refund of original Course fees will be made.
- Because you are under the influence of alcohol or drugs: you will be refused entry to the Course, your file will be returned to the police and the offer of the Scheme will be withdrawn. You will not be able to reschedule and no refund of original Course fees will be made.
- Because you are abusive, disruptive or fail to participate fully: you will be ejected from the Course, your file will be returned to the police and the offer of the Scheme will be withdrawn. You will not be able to reschedule and no refund of original fees will be made.
i) Rescheduling:
Rescheduling your Course, for any reason whatsoever, is your responsibility, subject to availability and the rescheduled Course must be completed within the Completion Period. Rescheduling is also subject to the following fees: if you reschedule more than 28 days before the date of your Course, there is no rescheduling fee; between 14 and 28 days before, there is a rescheduling fee of £30; less than 14 days before, you will have to pay the full Course fee again. Payment of rescheduling fess can only be made by credit or debit card.
j) Personal identification:
When you attend your Course, you must produce suitable photographic identification (e.g. driving licence or passport). If you do not have photographic ID, you must bring two separate forms of identification; for example, an original utility bill (gas, electricity or home phone) or council tax bill or a bank or credit card statement that we can match with your details given to us by the police.
k) Driving licence:
You must take your full driving licence (both paper and photo card if available) with you when you attend your Course. Failure to do so will result in you being refused entry, your file will be returned to the police and the offer of the Scheme will be withdrawn, unless you reschedule your Course. If you reschedule your Course, you will incur rescheduling fees (also see Clause i).
l) Medical conditions:
Before booking a Course, you must advise Driving Services if you have any medical conditions that may affect your attendance or ability to drive and confirm that you have advised the DVLA of these medical conditions. You must also notify Driving Services, if you are pregnant or have any special needs.
m) Eyesight:
As you are attending a Course involving practical driving, you must pass the basic Department for Transport eyesight test. This requires you to read a number plate successfully; old style plates from 20.5 m and new style from 20 m in good daylight. If you are unable to satisfy this requirement, your file will be returned to the police and the offer of the Course withdrawn. No refund of original Course fees will be made.
n) Course cancellation:
In the event of Driving Services being unable to deliver your Course for any reason outside of our control, we will reschedule your Course as soon as possible and in any case within the Completion Period and it will be free of any additional charge.
o) Special needs:
You must notify Driving Services of any special needs, for example disability and/or access issues, that you wish to be taken into consideration for the provision of the Course so that suitable arrangements can be made.
p) Warranties:
To the maximum extent permitted by law, Driving Services gives no warranties and makes no representations of any kind relating to the Course including, without limitation, any implied warranties of fitness for a particular purpose, or merchantability.
q) Liability:
To the maximum extent permitted by law:
- Driving Services will not in any circumstances (including, without limitation, negligence or breach of statutory duty) be liable for any loss of income, loss of opportunity or entitlement, loss of revenue or savings, or for any consequential damages (whether arising from any Course, from your attendance at, or inability to attend, any Course, or otherwise); and
- the liability of Driving Services to you arising out of any and all claims (whether arising from any Course, from your attendance at, or inability to attend, any Course, or otherwise) will not in any circumstances exceed in aggregate the total amount of the sums paid to you by Driving Services for the Course to which that liability relates.
